The Supreme Court has begun hearing BCCI’s petition to amend the constitution. Sourav Ganguly and Jay Shah have both spent six years with the BCCI/state association.
On Tuesday, the Supreme Court of India began hearing the BCCI petition to amend its constitution (September 13). This could result in significant changes to the Court’s recommendations for 2018. The hearing will resume on Wednesday. There is no official word on whether the court will issue a decision that day.
Only 18 months after the decision, the BCCI filed an appeal to change the constitutions. Which were set by the RM Lodha committee and approved by the court. The board approached again in April 2020 and has recently pressed the issue due to the upcoming elections later this month.
According to the current constitution. Office-bearers must serve a three-year cooling-off period for two consecutive terms. Either at the state association or at BCCI, or both. After that, a person is ineligible to compete at both the state and BCCI levels. And, as of now, all five office-bearers, including president Sourav Ganguly and secretary Jay Shah. Serve their six-year probationary period after joining the BCCI in October 2019.

For what reforms BCCI has appealed?
The most significant reform sought by the Ganguly administration is a cooling-off period. They want the cooling-off period to take effect. Only after the office-bearer has served for six years in a row at either the State or the BCCI, not both. Another major reform they want is to prevent the court from having a say if the BCCI changes its constitution in the future. The BCCI is also looking to change the constitution’s disqualification criteria for holding office (which currently state that anyone affiliated with a political party is ineligible to run).
Ganguly joined the BCCI in 2019 after serving as secretary of the Cricket Association of Bengal in 2014 and as president in 2015. Jay Shah also served as the Gujarat Cricket Association’s joint secretary. Rajiv Shukla, BCCI vice-president, has also completed his six-year term and is also a Member of Parliament, which precludes him from running in the upcoming elections.
Subramaniam Swamy, a Bhartiya Janata Party (BJP) member, petitioned the court to contest the BCCI Plea. He previously stated that the current BCCI administration intends to negate and destroy the cooling-off period, resulting in a power monopoly in the hands of a few individuals.
